Terms of Service for Wifi Net Heat Map

1. Description of Service

Wifi Net Heat Map is a utility application designed to help users measure and visualize the signal strength of Wi-Fi networks in their physical environment. The App allows users to create, save, and export heatmap data, optionally overlaid on a user-provided floor plan image.

2. License to Use

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms.

If you have acquired the "Free" version of the App, this license is for use of the features provided in that version.

If you have purchased the "Pro" version upgrade, this license extends to all features designated as "Pro". This includes the right to use the App for both personal and internal business purposes, such as analyzing Wi-Fi coverage within your own commercial or non-commercial premises.

This license does not grant you the right to resell, redistribute, or sublicense the App to third parties.

3. User Conduct and Responsibilities

You agree not to use the App for any purpose that is illegal or prohibited by these Terms. You are responsible for ensuring that your use of the App, including the use of any floor plan images you import, does not infringe on the copyrights, trademarks, or other intellectual property rights of any third party.

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Use the App in any way that could damage, disable, overburden, or impair it.
• Use the App for any mission-critical or safety-critical purposes where failure could lead to death, personal injury, or severe environmental damage. The data provided by the App is for informational purposes only and should not be relied upon for critical infrastructure planning without professional verification.

4. In-App Purchases and Pro Version

The App offers a "Free" version with limited functionality and a "Pro" version with enhanced features available through a one-time in-app purchase. All purchases are final and non-refundable, except as required by applicable law or Google Play's policies. The features designated as "Pro" are subject to change at our discretion.

5. Intellectual Property

The App and its original content (excluding content provided by users, such as floor plan images and generated heatmap data), features, and functionality are and will remain the exclusive property of Qalithra and its licensors. The App is protected by copyright, trademark, and other laws of both Estonia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

All data created by you, including data points and session files, remains your property and is stored locally on your device.

6. Disclaimer of Warranty

We do not warrant that the App will be uninterrupted, secure, or free from errors. We do not warrant the accuracy, completeness, or usefulness of the information (including signal strength data) obtained through the App. You acknowledge that Wi-Fi signal strength can be affected by numerous environmental factors and that measurements are provided for informational purposes only.

7. Limitation of Liability

In no event shall Qalithra OÜ, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App;
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein;
• Any interruption or cessation of transmission to or from the App;
• Any bugs, viruses, trojan horses, or the like which may be transmitted to or through our App by any third party.

8. Termination

We may terminate or suspend your license to use the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
